§ 8-08 Modification.

RCNY § 8-08

When the Department determines that strict application of any provision of this Chapter presents practical difficulties the Commissioner or their designee in a specific instance may modify the application of such provision consistent with the general purpose of this Chapter and upon such conditions as the Department deems necessary to protect life and health. Failure to comply with the terms of the modification may result in enforcement by the Department. The denial of a request for modification by the Commissioner shall be deemed a final agency determination. (Added City Record 4/7/2016, eff. 5/7/2016; amended City Record 4/8/2026, eff. 5/8/2026)
