§ 68-09 Final and Recommended Decisions.
RCNY § 68-09
(a)The decision of the Hearing Officer at the OATH Hearings Division is final subject to the appeals process provided for in 48 RCNY Chapter 5 and the Chairperson review process provided for in 35 RCNY § 68-12.
(b)The determination of an ALJ at the OATH Tribunal will be a Recommended Decision, subject to review by the Chairperson for the following matters: 1. findings and penalty determinations as to the fitness of Licensees under 35 RCNY § 68-14 or as a result of Discretionary Revocation proceedings under 35 RCNY § 68-13; 2. penalty determinations in padlocking or proceedings under subdivision (b) of § 19-528 of the Administrative Code; and 3. findings and penalty determinations in Summary Suspension proceedings pending Revocation and in Summary Suspension proceedings pending Compliance.
