§ 61B-16 Operations – Service Requirements (Passengers).

(a)No Pick-Ups Outside Authorized Area. No Commuter-Van Service Owner will permit the pick up or discharge of passengers outside of the geographical area established in the Owner's Authorization. 35 RCNY § 61B-16(a)Fine: $50 if plead guiltybefore a hearing; $100 if found guilty following a hearing.Appearance NOT REQUIRED (b) No Pick-Ups Along Bus Routes.
(1)Restriction. No Commuter-Van Service Owner will permit the pick up or discharge of passengers along any Official Bus Route. 35 RCNY § 61B-16(b)(1)Fine: $50 if plead guiltybefore a hearing; $100 if found guilty following a hearing.Appearance NOT REQUIRED (2) Grandfathered Exception.
(i)This restriction will not apply to the pick up and discharge of passengers along bus routes in Manhattan, south of Chambers Street, by Commuter-Van Service Owners that had authority on July 1, 1992 from the NYS Department of Transportation to pick up and discharge passengers along bus routes in that area (ii) The scope of operations by the exempted Commuter-Van Service, however, must not exceed the scope of its operations prior to July 1, 1992.
(c)Service Must Be Pre-Arranged. No Commuter-Van Service Owner will permit transportation service unless the service is prearranged and the prearrangement is shown on the Passenger Manifest. 35 RCNY § 61B-16(c)Fine: $50 if plead guiltybefore a hearing; $100 if found guilty following a hearing.Appearance NOT REQUIRED (d) Multiple Person Liability. The Commuter-Van Service Owner is liable for violating this Rule even when the actual violation has been unilaterally committed by the Commuter-Van Driver.
