§ 58-16 Compliance with Law – Miscellaneous.

RCNY § 58-16

(a)Compliance with Commission Rules and Regulations, Generally and Specifically.

(1)An Owner must comply with the Commission's Taxicab specifications, the Marking Specifications for Taxicabs, all pertinent provisions of the Administrative Code and other laws, rules or regulations governing Taxicab Owners. 35 RCNY § 58-16(a)(1)Fine: $200 if plead guilty before a hearing; $300 if found guilty following a hearing.Appearance NOT REQUIRED (2) Commercial Advertising and Commercial Sponsorships on the Back of Taximeter Receipts.

(i)Commercial advertising and commercial sponsorships may be printed on the back of receipts produced by a taximeter.

(ii)Any such advertising and sponsorships appearing on a receipt must comply with the commercial advertising and commercial sponsorship standards that apply to Passenger-facing content as set forth in 35 RCNY § 66-24(g)(3).

(iii)Any such advertising and sponsorships appearing on a receipt must not interfere with the readability of the fare information on the face of the receipt. 35 RCNY § 58-16(a)(2)(ii) and (iii)Fine: $200 if plead guilty before a hearing; $300 if found guilty following a hearing.Appearance NOT REQUIRED (b) Compliance with Accessible Taxicab Medallion Rules.

(2)An Owner must not file with the Commission any statement required under the Financial Disclosure provision (35 RCNY § 58-04(f)) that the Owner knows or should know to be false, misleading, deceptive or materially incomplete. 35 RCNY § 58-16(c)(1) and (2)Fine: Up to $10,000 per Medallion implicated in the violation and/or mandatory divestiture of any and all interests in any Taxicab Licenses held by the Owner, shareholder, officer, director or partner in violationAppearance REQUIRED (d) No Unlawful Purpose.

(3)The Owner of any Medallion, or the Technology System Provider and/or E-Hail Application used by the Owner of a Medallion, must pay the Taxicab Improvement Surcharge to the Taxicab Improvement Fund at the time and in the manner required by the Commission.

(4)If an Owner, or the Technology System Provider and/or E-Hail Application used by the Owner of a Medallion, does not pay the Taxicab Improvement Surcharge to the Taxicab Improvement Fund at the time required, nonpayment will be grounds for the suspension of the TLC license issued to the entity required to pay and/or by the denial of any renewal application or of any application for another TLC-issued license submitted by such entity, in addition to monetary penalties for such non-payment. 35 RCNY § 58-16(f)(1-4) Fine: $1,000 and suspension until complianceAppearance REQUIRED (Amended City Record 12/15/2016, eff. 1/14/2017; amended City Record 5/14/2018, eff. 6/13/2018; amended City Record 5/17/2018, eff. 6/16/2018; amended City Record 2/2/2023, eff. 3/4/2023)
