§ 58-04 Licensing – General Requirements.

RCNY § 58-04

(a)Identification. An individual or all Business Entity Persons of a Business Entity applying for a Taxicab License must provide to the Commission: (1) A Valid Government-issued photo ID and (2) A Valid Social Security Number.

(b)Age. An individual or all Business Entity Persons of a Business Entity applying for a Taxicab License or its renewal must be at least 18 years of age.

(c)Good Moral Character.

(1)An individual or all Business Entity Persons of a Business Entity applying for a Taxicab License must be fingerprinted and must be of good moral character. Fingerprinting for the purpose of investigating good moral character is also required of the following, unless waived by the Chairperson in his or her discretion: (i) Any new Business Entity Persons added by a Licensee (ii) Any individual or Business Entity Persons of a Business Entity that provides funds for any Owner, unless the provider is a licensed bank or loan company (2) Applicant's criminal history will be considered in a manner consistent with the Corrections Law of the State of New York.

(d)Fit to Hold a License. An individual or Business Entity must demonstrate to the satisfaction of the Commission that the Applicant is Fit to Hold the License of an Owner of a Taxicab License.

(e)Drivers Designated as Agents to Accept Service.

(2)Delivery of a notice of defect to a Driver will be adequate service of notice to the Owner.

(f)Financial Disclosure.

(3)The financial disclosure statement must be given under oath and must include all attachments and documentation required by the Commission.

(g)Liability Insurance. The Applicant must have liability insurance coverage by bond or policy as required by the State of New York and these Rules.

(h)Payment of Fines and Fees.

(i)Current Address and E-mail Address. An Applicant must give the Commission the Applicant's current Mailing Address and E-mail Address.

(j)An Applicant who, as an individual or as a Business Entity failed to make payments in accordance with a Loan Restructure 35 RCNY § 58-51, Medallion Relief Program, may not acquire an interest in a taxicab license for a period of five years from the date of default.
