§ 24-314 Right of entry on lands dedicated for highway or park purposes.

a. The department of environmental protection shall at all times have the unqualified right to enter upon all lands transferred or dedicated under the provisions of chapter six hundred sixty of the laws of nineteen hundred twenty-one, for highway or park purposes, to make repairs, replacements, additions, alterations or extensions to its water mains, pipes or works and for any other use of the property necessary to the purposes for which it was originally acquired, without applying for or obtaining the consent of any other authority. The department of environmental protection shall rebuild and replace any part of the road bed thus destroyed or torn up for water supply or incidental purposes, and restore it to a condition satisfactory to the authority having jurisdiction there- over. b. All owners of property adjacent to such strip dedicated for highway purposes shall have a right of way over every part of such land so dedicated.
