5101.6 Aerosol container size limitations.

FC § 5101.6

It shall be unlawful to store, handle or use Level 1 or 2 aerosol products in metal cans exceeding 33.8 fluid ounces (1000 ml), or in glass or plastic bottles exceeding 4 fluid ounces (118 ml). Level 3 aerosol products shall be stored, handled and used in containers with a maximum capacity of 24 fluid ounces (708 ml). Exceptions: 1. Pressurized ether shall be stored, handled or used only in metal containers with a maximum capacity of 8 fluid ounces (236 ml).

2.Level 1, 2 and 3 oven-cleaning aerosol products shall be stored, handled or used in containers with a maximum capacity of 16 fluid ounces (472 ml).

3.Level 1 or 2 aerosol products in plastic containers exceeding 4 fluid ounces (118 ml) but not exceeding 33.8 fluid ounces (1000 ml), and Level 3 aerosol products in plastic containers exceeding 4 fluid ounces (118 ml) but not exceeding 24 fluid ounces (708 ml), that meet one or more of the following conditions: 3.1. Base product has no fire point when tested in accordance with ASTM D 92, and nonflammable propellant. 3.2. Base product has no sustained combustion as tested in accordance with Appendix H, "Method of Testing for Sustained Combustibility in DOTn 49 CFR Part 173." 3.3. Base product contains up to 20 percent by volume (15.8 percent by weight) of ethanol and/or isopropyl alcohol in an aqueous mix, and nonflammable propellant. 3.4. Base product contains 4 percent by weight or less of an emulsified flammable liquefied gas propellant within an aqueous base. The propellant shall remain emulsified for the life of the product. Where such propellant is not permanently emulsified, the propellant shall be nonflammable.
