§ 26-3705 Enforcement.

AC § 26-3705

a. Notwithstanding any other provision of law, the commissioner of housing preservation and development shall enforce the provisions of this chapter and the regulations promulgated pursuant thereto. b. A cooperative corporation that violates or causes another person to violate a provision of this chapter or any rule promulgated pursuant to such chapter shall be subject to a civil penalty of $1,000 for a first violation, $1,500 for a second violation, and $2,000 for a third or subsequent violation. c. Where a cooperative corporation is found to have violated this section or any rule promulgated pursuant thereto, the department of housing preservation and development shall commence a proceeding to recover any civil penalty authorized by this section by the service of a summons returnable to the office of administrative trials and hearings.
