§ 82-42 Vehicle Equipment – Technology System Operation.

(a)Good Working Order. Licensees must ensure that the Technology System equipment is constantly maintained and is in good working order. 35 RCNY § 82-42(a)Fine: $250 and suspension until complianceAppearance REQUIRED (1) Accessible E-Hail Requests. While an Accessible Street Hail Livery is in operation, the Technology System must be turned on and able to receive Accessible E-Hail Requests.

(i)If the Technology System becomes incapable of receiving Accessible E-Hail Requests: (A) The Licensee, Agent or Base must replace or repair the Technology System promptly upon being notified to do so (as specified by the Commission) and in no event later than 48 hours after receiving such notification. 35 RCNY § 82-42(a)(1)(i) Fine: $250 and suspension until complianceAppearance NOT REQUIRED (ii) An Accessible Vehicle with a Technology System that is not capable of receiving Accessible E-Hail Requests cannot operate for more than 48 hours without repair or replacement of the Technology System. 35 RCNY § 82-42(a)(1)(ii) Fine: $250 and suspension until complianceAppearance NOT REQUIRED (2) No Tampering. An Agent or Licensee must not (i) Tamper with the Technology System; (ii) Tamper with the geographic locator equipment; (iii) Disable the Technology System’s ability to receive Accessible E-Hail Requests; or (iv) Render the Accessible E-Hail Request functionality inoperable in any way. 35 RCNY § 82-42(a)(2) Fine: $350 and/or suspension up to 30 daysAppearance REQUIRED (b) Failure to Operate.

(1)If the Technology System malfunctions or fails to operate, an incident report must be filed with the Technology System Provider within two (2) hours following the discovery of the malfunction or at such time as the Licensee reasonably should have known of the malfunction.

(2)If the Street Hail Livery Driver filed the incident report, the Licensee will not be required to file a separate incident report but must verify the filing by obtaining the incident report number.

(3)The Licensee must meet the appointment for repair scheduled by the Technology System Provider following the incident report.

(c)48-Hour Repair Deadline. A Street Hail Livery in which any material feature of the Technology System is not functioning must not operate more than 48 hours for Hail Trips following the timely filing of an incident report (Pre-Arranged Trips are not subject to this requirement). 35 RCNY § 82-42(c)Fine: $250 and suspension until complianceAppearance REQUIRED (d) Inspection upon Multiple Technology System Malfunctions. The Licensee of any Street Hail Livery requiring six (6) or more repairs of the Technology System in any thirty (30) day period must promptly take the vehicle for inspection to, or schedule an inspection with, the Commission's Safety and Emissions Facility.
