§ 82-17 Compliance with Law – Miscellaneous.

RCNY § 82-17

(a)Compliance with Commission Rules and Regulations, Generally. The Licensee must comply with the Commission's Street Hail Livery specifications, the Marking Specifications for Street Hail Liveries, all pertinent provisions of the Administrative Code and other laws, rules or regulations governing Street Hail Livery Licensees. 35 RCNY § 82-17(a)Fine: $200 if plead guilty before a hearing; $300 if found guilty following a hearing.Appearance NOT REQUIRED (b) Alcohol and Drug Laws. A Street Hail Livery Licensee must not knowingly allow a Street Hail Livery to be operated by a Driver who is under the influence of any drugs or alcohol or whose driving ability is in any way impaired. 35 RCNY § 82-17(b)Fine: $10,000 and revocationAppearance REQUIRED (c) Payment of all Fines and Judgments. The holder of a Street Hail Livery License issued under this Chapter must satisfy any outstanding judgment and pay any civil penalty owed for a violation relating to traffic in a Qualified Jurisdiction or for a violation of the regulations of a Qualified Jurisdiction. 35 RCNY § 82-17(c)Penalty: Suspension until satisfaction or paymentAppearance NOT REQUIRED (d) No False Statements.

(1)A Licensee must not file with the Commission any statement required under the Special Requirements for Business Entities provision, 35 RCNY § 82-06(c), that the Licensee knows or should know to be false, misleading, deceptive or materially incomplete. 35 RCNY § 82-17(d)(1)Fine: Up to $10,000Appearance REQUIRED (e) No Unlawful Purpose.

(2)For trips provided in WAV vehicles, the Street Hail Livery Improvement Driver Incentive Payment (as specified in 35 RCNY § 82-70(b)) will be paid directly to the Driver by the Technology System Provider and/or E-Hail Application Provider at the time and in the manner required by the Commission.

(3)When any Street Hail Livery Improvement Surcharge amount due is not collected by the Technology System Provider and/or E-Hail Application Provider, the Street Hail Livery Licensee must pay the entire such amount, as remitted by the Street Hail Livery Driver, to the Street Hail Livery Improvement Fund.

(4)The Street Hail Livery Licensee, or the Technology System Provider and/or E-Hail Application used by the Street Hail Livery Licensee, must pay the Street Hail Livery Improvement Surcharge to the Street Hail Livery Improvement Fund at the time and in the manner required by the Commission.

(5)If a Street Hail Livery Licensee, or the Technology System Provider and/or E-Hail Application used by the Street Hail Livery Licensee, does not pay the Street Hail Livery Improvement Surcharge to the Street Hail Livery Improvement Fund at the time required, nonpayment will be grounds for the suspension of the TLC license issued to the entity required to pay and/or by the denial of any renewal application or of any application for another TLC-issued license submitted by such entity, in addition to monetary penalties for such non-payment. 35 RCNY § 82-17(g)(1)-(5) Fine: $1,000 and suspension until complianceAppearance REQUIRED (Amended City Record 5/14/2018, eff. 6/13/2018; amended City Record 2/2/2023, eff. 3/4/2023; amended City Record 5/10/2023, eff. 6/9/2023; amended City Record 6/20/2024, eff. 7/20/2024)
