§ 8-06 Prohibitions.

RCNY § 8-06

A sound device permit will not be issued for: (a) Any location within 500 feet of a school, courthouse or church during hours of school, court or worship, or within 500 feet of a hospital or similar institution; (b) Any location where the Department, upon investigation, determines that conditions of vehicular or pedestrian traffic, or both, are such that use of such a device or apparatus will constitute a threat to the safety of pedestrians or vehicle operators; (c) Any location where the Department, upon investigation, determines that conditions of overcrowding or street repair, or other physical conditions are such that use of a sound device or apparatus will deprive the public of the right to safe, comfortable, convenient and peaceful enjoyment of any public street, park or place, or constitute a threat to the safety of pedestrians or vehicle operators; (d) Use in any vehicle or other device while it is in transit; (e) Between the hours of 10 p.m. to 9 a.m.

(f)A permit to use a sound device or apparatus for commercial or business advertising purposes. Note: These Regulations do not apply to use or operation of any sound device or apparatus by any church or synagogue on or within its own premises in connection with religious rites or ceremonies.
