§ 54-05 Certifications of Violations.

RCNY § 54-05

(a)1. An owner's certification of correction of a pest violation that was issued, pursuant to Administrative Code § 27-2017.4(a) must, where directed by the Department, include an affidavit affirming that the work practices required in accordance with 28 RCNY § 54-05(a) were properly performed.

2.An owner's certification of correction of a pest violation that was issued, pursuant to Administrative Code § 27-2017.4(b) must include an affidavit affirming that the work practices required in accordance with 28 RCNY § 54-04(a) were properly performed. The Department may also require additional documentation for certification of correction of a violation of § 27-2017.4 deemed necessary to ensure that the violation has been properly corrected.

3.An owner's certification of correction of an indoor mold hazard violation issued, pursuant to Administrative Code § 27-2017.3 must include an affidavit affirming that the work practices required in accordance with 28 RCNY § 54-04(b) were properly performed. Where licensed workers are required to be used to correct an indoor mold hazard, pursuant to New York State Labor Law Article 32, or, pursuant to Administrative Code § 24-154, such certification must include an affidavit by the remediator and by the assessor indicating that the work practices and notices required under those laws and rules, as set forth in 28 RCNY § 54-04(b) were complied with, and shall include proof that the remediator's remediation plan and the assessor's final report were submitted to the Department of Environmental Protection in accordance with Administrative Code § 24-154. The Department may also require additional documentation for certification of correction of a violation of § 27-2017.3 deemed necessary to ensure that the violation has been properly corrected.
